Constitutional Amendment

11 November 2025

-

Parliament has unanimously passed an amendment to the Constitution, repealing Section 28, the "notwithstanding clause," which previously allowed legislation to be passed ignoring parts of the Charter of Rights and Freedoms.

In repealing this Section, Aquria-Catopolis shows its commitment to the protection of the fundamental rights of its citizens.

Per Section 28:

"18 (1) Parliament or the legislature of a province may expressly declare in an act of Parliament or of the legislature, as the case may be, that the act or a provision thereof shall operate notwithstanding a provision included in section 2 or sections 6 to 14 of this Charter."

In simpler terms, Parliament, or a provincial government, may declare that legislation of Parliament, or that province, shall not be affected by section 2 and/or sections 6 to 14 of the Charter.
